Debt Recovery and Financial Support

Bank 2179 640

Yorkhill Housing Association takes a proactive and supportive approach to managing factoring accounts. Our goal is to help owners stay on top of their payments and avoid falling into arrears.

We encourage all owners to set up a monthly direct debit to spread the cost of factoring charges and support better budgeting. If you're experiencing financial difficulty, we urge you to contact us as early as possible to speak with someone in confidence. Our team is here to help.

Our full Debt Recovery Procedures are available on request.

If you're struggling to pay your factoring charges, we can:

  • Discuss flexible payment arrangements
  • Refer you to trusted agencies such as Citizens Advice Bureau or Money Matters
  • Offer access to our Welfare Rights Service, who can provide free, impartial, and confidential advice on welfare benefits, budgeting and debt management

If you do not respond to our reminder letters or contact us to discuss your account, we may begin formal debt recovery proceedings. This includes recovering the full amount owed as well as any associated legal costs.

Where necessary, we may take the following steps to recover unpaid factoring charges:

  • Trace the owner to their current home or business address
  • Notify the mortgage provider if buildings insurance has not been paid
  • Instruct Sheriff Officers to visit the property
  • Attach a Notice of Potential Liability for Costs to the property title
  • Initiate court action if the debt exceeds £250, or there is a pattern of persistent arrears with no payment plan in place.
  • If a decree for payment is granted, we may instruct Sheriff Officers to carry out enforcement actions such as wage arrestment or property attachments.
